Interpretation

In these Terms and Conditions of Sale (“Terms”), “Goods” means the goods subject of the Contract; “Exit Offroad” means the entity selling the Goods; “Customer” means the entity purchasing the Goods; “Contract” means each contract between Exit Offroad and Customer for the sale and purchase of Goods.

Title

Title to the goods will not pass to the Customer until the following is completed:

Exit Offroad being paid in full under all Contracts.  Until the Goods pass to Customer, Customer must: Hold the Goods as bail for Exit Offroad and keep them in good order and condition; and not remove any markings placed by Exit Offroad and ensure that the Goods can be readily identified and distinguished from other property in Customer’s possession; and deliver the Goods to Exit Offroad immediately upon demand and, for this purpose, Exit Offroad is authorized to enter at any time any premises in which the Goods may be located (the costs incidental to which will be borne by Customer). A 5% processing fee will be deducted from any order Cancelled that has not yet shipped. This will be deducted from the refund. You can verify stock prior to ordering via email or phone call to avoid placing an order for something that may not ship right away. Any handling fee charged at the time an order is placed is not valid for a refund under any circumstances.

Quotations & Orders

Any quotation made by Exit Offroad will not be construed or operate as an offer or obligation to sell. Exit Offroad reserve the right to accept or reject in its absolute discretion any order received. Customer will not be entitled to cancel or refuse delivery of, or payment for, any order made by him, which has been accepted by Exit Offroad.

Price

The price payable to Exit Offroad by Customer for the Goods will be the price agreed, failing which it will be the price prevailing at the date the Goods are dispatched by Exit Offroad for delivery to Customer. Prices are payable in US Dollars and exclusive of delivery costs, taxes, duties and other imposts which, if chargeable, are payable by Customer. Prices quoted in any Exit Offroad price list are suggested prices only and may be changed by Exit Offroad without notice.

Payment

All Goods will be paid for in full before receiving or dispatching of Goods from Exit Offroad unless previously arranged. A 5% processing fee will be deducted from any order Cancelled that has not yet shipped. This will be deducted from the refund. You can verify stock prior to ordering via email or phone call to avoid placing an order for something that may not ship right away. Any handling fee charged at the time an order is placed is not valid for a refund under any circumstances.

Shipping

We use the most reliable, fastest and affordable shipping companies to move the products that we sell. High value orders ship with an adult signature required, so that your $4000 suspension for example isn’t just dropped at your door then a porch pirate steals it and you’re out of all that product and money. Parts that are in transit cannot be stopped or turned around, they can only be refused when the delivery attempt is made. It that is not an option, then the standard return process would need to be followed. Shipments cannot be redirected by us. You can contact the shipping company (eg. Fedex, UPS) with the tracking number provided and have it held at a local facility for pickup using the information provided on the tracking page.

Damage

Buyer acknowledges that the Goods leaving Exit Offroad’s and their suppliers’ premises are adequately packed. Claims for damage in transit must be made against the carrier and, while Exit Offroad will not accept liability for any damage, details of any claim must be promptly advised to Exit Offroad. Prior to acknowledging delivery to the carrier, Customer must ensure that the complete consignment has been received as specified in the carrier’s note. Any shortage or visible damage to outer packaging must be endorsed on the carrier’s note. Any shortages and/or damages must be reported to Exit Offroad within 72 hours of receipt.

Route Package Protection Service

Route Package Protection service is an optional feature presented in the checkout process. It is like insurance for the safe transport and delivery of your package(s) and the cost of that service is automatically calculated during checkout. To not purchase that service, simply press the toggle before payment is made on the checkout page to turn it off. Once a shipment has been shipped, Route cannot be cancelled. Implied Terms, Limitation of Liability & Customer Indemnity

Subject to these Terms, Exit Offroad will not be liable for any loss, damage, expense or injury of any kind or nature suffered or incurred by Customer or any other person, arising out of or in connection with, the Contract (including, without limitation, liability due to negligence or willful default of Exit Offroad and any delay in delivery) or any error (whether negligent or not) in information supplied to Customer in connection with its subject matter or the use, possession or delivery of the Goods or the exercise by Exit Offroad of its right under Breach by Customer will indemnify Exit Offroad in relation to any such loss, damage, expense or injury.

Force Majeure

Despite any other term or condition of the Contract, Exit Offroad will not be liable for any loss, damage, expense or injury of any kind or nature suffered or incurred by Customer or any other person, arising out of or in connection with any delay in delivery, or failure to perform any other term or condition of the Contract where that delay or failure is caused by an act of God, fire, labor dispute, civil commotion, intervention of a government, inability to obtain labor, materials or manufacturing facilities, accidents, interruptions of or delay in transportation or any other cause beyond Exit Offroad’s reasonable control.

Breach by Customer

If Customer breaches a Contract or Exit Offroad is not satisfied of a Customer’s ability to pay or otherwise comply with each Contract, Exit Offroad may by notice to Customer, but without compensation, terminate every Contract, suspend or cease deliveries under all Contracts, set-off all deposits against amounts due and make all amounts then outstanding by Customer to Exit Offroad immediately due and payable.

Cancellations

Order cancellations are subject to Exit Offroad’s approval, and all requests must be made in writing by replying to your order confirmation email. Typically, orders are shipped out as fast as possible, so if an order has already been picked and packed and is awaiting pickup by the shipping carrier (Fedex, UPS, etc), it cannot be cancelled. Orders that include strut assembly or any labor charge cannot be cancelled, as that is work specifically ordered by the customer for those parts at the time the order is placed. Orders that have already shipped (already picked up by the carrier) cannot be cancelled. Parts that are in transit cannot be stopped or turned around, they can only be refused when the delivery attempt is made. It that is not an option, then the standard return process would need to be followed. Refunds are made only to the original payment method, or to be used as credit towards another order. If an order is cancelled, a 5% service fee will be deducted from the refund to cover the cost of processing and handling, no exceptions. The order cancellation fee during a sale period (such as Black Friday) will be 10%. Any orders placed that are on sale will be subject to this fee.

Returns

Window for return is 30 days from date of receipt, no exceptions. Customers are responsible for all return shipping charges, plus a 20% restocking fee. Those charges will be deducted from the refund. Items must be returned in new, re-sellable condition in their original unopened packaging, or refunds won’t be issued. Parts that are assembled or modified before shipping cannot be returned. Defective products or products with issues must be first discussed with Exit Offroad in case there is a more simple resolution to solve the problem. No electronic items sold at exitoffroad.com can be returned once opened.

Customers returning items because they changed their mind, bought the wrong size, or simply don’t need it any more are still responsible for return shipping fees plus the 20% restocking fee.  Used or installed products cannot be returned and will only be returned to the Customer at the Customer’s full expense. Assembled parts cannot be returned. Parts with any purchased labor component prior to shipping cannot be returned. No labor charges can be refunded or returned. No electronic products can be returned once opened from the original packaging.

Anything shipped by truck freight (on a pallet) will result in a 20% restocking fee, plus any return shipping costs ($300-550 approximately), due to the high costs of shipments by truck freight, on a pallet.  Customers who do not pick up their truck freight orders from the freight depot in a timely manner may have their items disposed of at the discretion of the truck freight company based on their terms and conditions of service.  In such a case, no refunds of product costs or shipping will be made. Prompt pickup of the Customer’s parts from the truck freight company is required on the Customers’ part.

For products returned that cannot be refunded, the buyer will be contacted to either have the product returned to them at their expense, or the items will be disposed of.

Refunds are made only to the original payment method, or to be used as credit towards another order.

For any items that were purchased under a “free shipping” discount or promotion and then returned, the Customer will be responsible for the inital outbound shipping costs. This will be deducted from the refund amount in addition to any other associated return fees. There are no exceptions to this. Shipping costs are real and it isn’t actually free, and if items are not kept, you will be charged for that initial shipping fee upon returning the items.

Fraud and Chargebacks

We have many procedures in place to help protect you and ourselves against fraud. Exit Offroad does not keep any credit card info on file at any time. We also work closely with local and international law enforcement agencies to help prosecute all fraud cases. ALL FRAUD CASES WILL BE PROSECUTED TO THEIR LEGAL LIMITS. Some orders may be delayed if fraud is suspected, and you may be asked to provide additional information and/or proof of identification.

Errors and Omissions

Exit Offroad has the right to correct any clerical errors or omissions, whether in computation or otherwise in any quotation, acknowledgment, or document forming part of a Contract. Stock levels change daily and rapidly and all stock levels quoted on this site are subject to change at any moment. Although care has been taken to ensure the accuracy of the data contained in this publication, Exit Offroad does not assume any liability for errors or omissions and reserves the right to make corrections to any information on this website at any time without notice. Products are covered by the manufacturer’s warranty of that brand. All warranty claims must be made directly with the brand or company that manufactures the product in question, as they are the ones providing the Manufacturer’s Warranty.
